1. Introduction
Welcome to Poets And Pilgrims. This User Agreement constitutes a binding contract between you, the “User/member/participant” and “Poets And Pilgrims/the website/we” with regard to the use of various “services/activities/experiences” that are provided by Poets And Pilgrims. Please read them carefully.
2. Definitions
- “User” refers to anyone accessing or using our services.
- “Service” refers to all offerings by Poets And Pilgrims “activities”.
- “Booking” refers to the process of reserving a specific service through our platform.
3. Acceptance of Terms
By accessing our website or using our services, you confirm that you have read and accept these Terms and Conditions and that you agree to comply with them.
4. Services Offered
Poets And Pilgrims provides various activities or life experiences, including but not limited to adventure trips, workshops, dining experiences, and cultural immersions. Details of each activity are available on our website.
5. Bookings and Payments
- All bookings must be made in advance via our Website.
- Prices are subject to change and may be updated without prior notice; the final price will be confirmed at the time of booking.
- All prices are in Indian Rupees (INR). Payments made in foreign currency may attract additional charges by banks, card issuers, and payment processors. Poets And Pilgrims is not responsible for these charges.
- Users may pay a deposit to secure their spots. Bookings are considered final only after the full payment is received.
- Payment must be made at the time of booking through authorised payment methods only.
- Final payment must be paid by the latest 30 days before the activity start date. Failure to do so entitles Poets And Pilgrims to cancel your reservations without notice.
6. Cancellation and Refund Policy
- Users may cancel their bookings and request a refund as detailed in our Refund Policy document.
7. User Obligations
Users:
- Must provide complete and accurate information during the booking process.
- Are responsible for their personal health, safety, and belongings.
- Must follow all guidelines provided by Poets And Pilgrims during activities.
- Are advised to secure their own insurance as necessary and opt for refundable tickets.
8. Liability
- Poets And Pilgrims is not liable for any injuries, damages, or losses incurred during activities.
- Poets And Pilgrims is not responsible for losses incurred due to Users’ health emergencies, sickness, inability to participate, or other reasons.
9. Change Of Plans
Circumstances beyond control may force change of plans including but not limited to route/itinerary changes, delay in departure or early conclusion, and change of service providers. In such case, Poets And Pilgrims reserves the right to modify, delay or cancel an activity. If an activity is cancelled, Users will be given a credit note. Users will not be entitled to make any further claim for any personal or professional loss, expenses, or damage (direct or consequential) or for any inconvenience that may result from such cancellation.
10. Force Majeure
Poets And Pilgrims shall not be held liable or responsible for any delay or failure in fulfilling its obligations under these Terms and Conditions where such failure or delay is caused by circumstances beyond Poets And Pilgrims’ reasonable control. These circumstances may include, but are not limited to:
- Natural disasters (e.g., earthquakes, floods, hurricanes)
- Acts of God
- War or acts of terrorism
- Strikes or labour disputes
- Epidemics, pandemics
- Civil unrest
- Government actions (e.g., mandatory closures, travel restrictions)
- Rail, airline or other transportation disruptions
- Technical failures or outage
In the event of a force majeure, Poets And Pilgrims will make reasonable efforts to notify Users at the earliest and, where feasible, offer alternate arrangements. However, Poets And Pilgrims shall not be liable for any refunds, losses, or damages incurred by the User as a result of the force majeure event.
11. Service Providers
Poets And Pilgrims partners with third-parties to provide us with services like transportation, accommodation, food etc – collectively “service providers.” Poets And Pilgrims does not own, operate, control, or endorse these service and is not responsible for services provided by third-parties.
12. Health, Safety, Code of Conduct
Users must be physically fit to participate in activities. Some activities may involve challenging situations. Users are expected to understand health and fitness requirements and consult a physician before making a booking.
Poets And Pilgrims activities are inclusive and have a diverse group of members. All Users shall respect other participants and staff members. If at any point before or during an activity a User is found to create a situation which is unsafe or unpleasant for others, or is deemed likely to affect the operations of our Services, Poets And Pilgrims reserves the right to remove the User from the group. Poets And Pilgrims shall not be liable in any regard for such member.
Users must follow local laws and regulations of the place where the activity is taking place and not engage in unlawful, antisocial, or unsafe behaviour.
13. Personal Information
- Poets And Pilgrims collects personal information to provide services. By using our services, you consent to our Privacy Policy.
- During an activity, Poets And Pilgrims may take your photographs or videos documenting your experience. We may publish these photographs/videos on Poets And Pilgrims website, our social media accounts, video hosting websites, or print/electronic media, promotional content etc. You waive the condition of obtaining your prior consent to being included in a photograph/video or the publication of such media.
14. Changes to Terms
Poets And Pilgrims reserves the right to update these Terms and Conditions without prior notice. Users are encouraged to review these terms periodically.
15. Governing Law
These Terms and Conditions are governed by the laws of The Republic of India, without regard to its conflict of laws principles.
